Welcome to Curvia Care. These Terms of Service ("Terms") govern your access to and use of the Curvia Care platform, including our website, mobile applications, and Electronic Health Record (EHR) services (collectively, the "Services"). Please read these Terms carefully before using our Services.
1. Acceptance of Terms
By accessing or using the Services provided by Curvia Care ("Company", "we", "us", or "our"), you agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of a healthcare facility, clinic, pharmacy, or other medical institution, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
Curvia Care provides a comprehensive healthcare management platform, including EHR, appointment scheduling, billing, pharmacy management, and laboratory modules. Our Services are designed to assist healthcare providers in managing their operations and patient care. Curvia Care is a technology platform and does not provide medical advice, diagnosis, or treatment.
3. User Accounts and Security
- Registration: You must create an account to use the Services. You agree to provide accurate, current, and complete information.
- Security: You are responsible for safeguarding your login credentials. You must immediately notify us of any unauthorized use of your account.
- Access Control: Facility administrators are responsible for managing access levels for their staff. You agree that Curvia Care is not liable for unauthorized access resulting from improperly configured staff permissions.
4. Patient Data and HIPAA / Data Privacy Compliance
As an EHR system provider, Curvia Care acts as a Data Processor (or Business Associate) for the healthcare facilities (Data Controllers or Covered Entities) using our platform.
- Compliance: You are responsible for ensuring that your collection and use of patient data complies with all applicable local, national, and international health data protection laws.
- Data Ownership: You retain all rights to the patient data entered into Curvia Care. We do not claim ownership of your data.
- Data Security: We implement industry-standard security measures, including end-to-end encryption, to protect Protected Health Information (PHI). However, no system is entirely impenetrable.
5. Acceptable Use Policy
You agree not to use Curvia Care to:
- Violate any local, state, or international laws, including healthcare regulations.
- Upload malicious code, viruses, or attempts to breach our security infrastructure.
- Sell, resell, or lease access to the platform without explicit authorization.
- Access patient records for which you do not have authorized clinical or administrative need.
6. Subscription, Billing, and Cancellation
Curvia Care is a subscription-based service. Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time; however, no refunds will be provided for partial subscription periods. Upon cancellation, you will have 30 days to export your patient data before it is permanently deleted from our active servers.
7. Limitation of Liability
To the maximum extent permitted by law, Curvia Care and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Curvia Care is not liable for clinical outcomes or medical errors resulting from the use of the platform. Medical professionals must use their independent clinical judgment.
8. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or through the platform interface. Continued use of the Services after modifications constitutes acceptance of the updated Terms.
